I, Stephen G. B. Henry, hereafter referred to
as the Seller, agree to sell Roger/Kristina Bolhouse ,
hereafter referred to as the Buyer, a German Shepherd (dog/bitch) registered under the name of Daphne Von Haus Henry, as a (pet/working/show) dog. The (dog/bitch) can be identified with the information below:
Sire: V Salo vom Steigerhof , SZ 2124737, Tattoo #H-G 4137_
Dam: Venja Von Der Hohen Eiche, SZ2053787, Tattoo # N-T 5258
The above German Shepherd is being sold for the price of $0.00 dollars. The full amount must be paid prior to the release of the above mentioned German Shepherd and before any transfer of ownership papers. If shipping is required, the price of an animal “Jet Box” and shipping cost will incur additional charges and must be agreed upon and paid for, by the Buyer before the above German Shepherd is shipped to the Buyer.
The Buyer is responsible for any and all shipping fees related to the above German Shepherd. If the Buyer fails to perform his/her obligations as per this contract, the Seller may repossess the above dog and retain any reasonable expenses, including legal fees if necessary.
If shipping has to occur, the Seller guarantees the health of the above German Shepherd for Seventy-two(72) hours after it leaves the Seller’s possession. The Seller is not responsible for loss or injury to this dog once it leaves the Seller’s actual possession. The Buyer should have the above German Shepherd examined by a licensed veterinarian within the above mentioned seventy-two(72) hour period to verify the animal’s health at the time of sale. If a health problem is found at this time, the Buyer shall immediately contact the Seller. If shipping does not occur, the Buyer still has seventy-two(72) hours to have the above mentioned German Shepherd examined by a licensed veterinarian, from date of possession, to fulfill the above mention requirement. The Seller is not responsible for any bills incurred by the Buyer unless authorized by the Seller(per phone conversation, E-Mail, written correspondence, ect.). The Seller will not pay any portion of this routine checkup(within 72 hrs of purchase) to verify the above German Shepherd’s health.
Providing the Buyer maintains proper care of the above German Shepherd and follows the guidelines provided in the puppy care package(reference document entitled “Proper Care Of Your German Shepherd Puppy”) that is provided with each puppy(and accompanies this contract), the Seller further guarantees the above German Shepherd to be free of any hip abnormality, elbow abnormality(excluding hydromas) or major organ abnormality from twenty-four (24) months of the date of purchase. Hip/elbow abnormality as it relates to this Purchase Contract is defined as moderate to severe hip/elbow dysplasia. The Seller will replace the dog/bitch with one of the same sex and approximate age as this dog/bitch, at the time of sale or the Seller will refund the original purchase price of the dog, in exchange for the animal in question. Individual circumstances will dictate whether the dog is replace or purchased back by the Seller. The replacement puppy will be made available to the Buyer within twelve(12) months, of original purchase, based upon availability of puppies, after proof has been provided by the Buyer, that the above German Shepherd has never been bred, neutered or spayed. Only one(1) replacement dog will be provided. Puppies purchased are guaranteed to “A” stamp under the German SV system. Further guarantees may be discussed on an individual basis and written into this contract. The warranty of this contract is directly linked/tied/connected to the document entitled, “Proper Care Of Your German Shepherd Puppy”, that accompanied this dog. When the guidelines of this document are not followed, the warranty of this contract is voided. The aforementioned document and this contract work in unison to form the warranty covered during the first 24 months of this dog’s life.
Should the Buyer spay or neuter the above mentioned puppy before it’s 24 month birthdate, all warranties provided by this contract will become void and the Seller will no longer be responsible for any health abnormalities that manifest themselves in the spayed or neutered animal. If this dog is spayed or neutered before two(2) years old, the Buyer is on his/her own, if the dog incurs ANY health problems, whatsoever.
The Seller also claims the right of first refusal. This means that if the Buyer chooses to sell, give away, or otherwise dispose of the above animal, the Seller has the first option(should the Seller decide to exercise it) to recover the animal, at the original purchase price. If the person buying this dog is buying it for someone else or if the ownership is transferred in any way, this contract is considered null and void from a warranty standpoint.
